1. Controller

DS SafetyWear Arbeitsschutzprodukte GmbH, Deutz-Mülheimer-Str. 121, 51063 Köln (Cologne), Germany. Phone +49 221 292096-50, email info@dssafetywear.de. Further details in the legal notice.

2. The key points in brief

This website does not set cookies, does not store anything in your browser’s storage and does not integrate any analytics, advertising or social media services. Fonts, images and videos are delivered by this website’s hosting provider (server and content delivery network, see section 3); no data is transferred to third parties such as Google when you visit it. We process personal data when you visit the pages (server log files) and when you contact us via the enquiry form, by email or by phone.

3. Hosting and server log files

The website is hosted by Hostinger. The contractual partner is Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus. The server is located in Düsseldorf (Germany); backups are stored in France. A data processing agreement in accordance with Art. 28 GDPR is in place with Hostinger; it forms part of Hostinger’s terms of service (Data Processing Addendum). If Hostinger processes data outside the European Economic Area, this is done on the basis of the European Commission’s standard contractual clauses.

When a page is accessed, the server processes technically necessary data: IP address, date and time, requested address, amount of data transferred, status code, referring page (referrer) and information about the browser and operating system. The purpose is to deliver the website and to ensure secure and stable operation. The legal basis is Art. 6(1)(f) GDPR. The log files are deleted as soon as they are no longer required for this purpose. The retention period is set by the hosting provider within its technical specifications.

The pages are delivered via Hostinger’s content delivery network (CDN), which stores copies of the pages, images and scripts on regionally distributed servers so that they load faster. The provider of the CDN is HOSTINGER operations, UAB, Švitrigailos str. 34, Vilnius 03230, Lithuania. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in a stable and fast website). A data processing agreement is in place with the provider.

4. Enquiry form (samples, quote, advice)

Via the form you transmit your company, contact person and email address, for sample requests also the delivery address, and on a voluntary basis your phone number, delivery location, activity, noise level, requirements and message. A script on this website’s server forwards the details by email to info@dssafetywear.de. They are not stored on the web server; no external form service is used. The mailbox is hosted by Microsoft 365 (Exchange Online). The contractual partner is Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland. A data processing agreement in accordance with Art. 28 GDPR is in place with Microsoft; it forms part of the Microsoft Product Terms (Data Protection Addendum). Microsoft stores and processes the data within the EU Data Boundary. If, in individual cases, data is transferred to the USA, this is based on Microsoft’s certification under the EU-US Data Privacy Framework (Art. 45 GDPR) and on standard contractual clauses (Art. 46(2)(c) GDPR).

The purpose is to process your enquiry and, for sample requests, to send the samples. The legal basis is Art. 6(1)(b) GDPR insofar as you yourself wish to become a contractual partner. If you are enquiring on behalf of a company, the legal basis is Art. 6(1)(f) GDPR; our legitimate interest is answering business enquiries. The mandatory fields are required for processing; without them we cannot answer the enquiry.

We delete the details once the enquiry has been dealt with. If a business transaction results from it, we retain documents within the scope of our statutory obligations, in particular under § 257 of the German Commercial Code (HGB) and § 147 of the German Fiscal Code (AO) (up to ten years).

To protect against mass enquiries, the server stores a hash value (checksum) of your IP address together with the time of the enquiry for a maximum of one hour, not the IP address itself. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in a form free from abuse).

5. Contact by email or phone

If you contact us by email or phone, we process your details to deal with your request, in accordance with Art. 6(1)(b) GDPR for contract-related enquiries and otherwise in accordance with Art. 6(1)(f) GDPR. Section 4 applies to the Microsoft 365 mailbox, deletion and retention.

6. Links to other websites

This website links to the B2B shop dssafetywear.de, to data sheets, user instructions and declarations of conformity stored with the shop’s service provider Shopify (cdn.shopify.com), and to laws, standards and specialist sources. Only when you click on such a link does your browser access the external page, transmitting your IP address, among other things, to its operator. Links to the shop contain campaign parameters (UTM) that show which page of this website you came from. Processing in the shop is governed by the shop’s privacy policy. Shopify’s contractual partner in Europe is Shopify International Limited, 2nd Floor, 1–2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland. Data may be transferred to third countries, in particular to Canada and the USA. According to its own information, Shopify bases such transfers on binding corporate rules approved by European data protection authorities and on standard contractual clauses.

7. Cookies and access to your device

This website does not store any information on your device and does not read any information from it that is not strictly necessary for display (§ 25 of the German Telecommunications Digital Services Data Protection Act, TDDDG). A consent banner is therefore not required. Should analytics or advertising services be used in the future, this will only happen with your consent; this policy will then be updated.

8. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), notification to recipients (Art. 19) and data portability (Art. 20). A message to info@dssafetywear.de is sufficient.

Your right to object

Where we process your data on the basis of our legitimate interests (Art. 6(1)(f) GDPR, for example for server log files and to protect the form), you may object to this processing at any time on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims. The objection can be sent informally to info@dssafetywear.de.

You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), for example with the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia, which is responsible for us (ldi.nrw.de).

9. Storage period

We only store personal data for as long as the respective purpose requires or statutory retention periods demand, for example under § 257 HGB and § 147 AO. The period for server log files is given in section 3, for enquiries and the protection of the form in section 4. After that, the data is deleted unless there is a legitimate interest in storing it further. There is no processing based on consent on this website.

10. No automated decision-making

We do not make decisions based solely on automated processing, including profiling (Art. 22 GDPR). The hearing protection finder calculates only in your browser and does not store any input.
